How did Toll Brothers survive the housing slump? By keeping buyers

As newly minted empty-nesters, Daven Sharma and his wife, Anu, spent 2010 searching for a spot for their dream house with views of San Francisco Bay. They found it in the Hayward hills, within a Toll Brothers development.

Shortly after plunking down about $100,000 in deposits, the couple's dream fizzled. The Sharmas lost not only the house, but their deposit, attorney and arbitration fees -- and a sense of justice.

Critics say and records show that Pennsylvania-based Toll Brothers -- the nation's largest luxury homebuilder, with developments in Contra Costa, Alameda, Santa Clara and San Mateo counties -- has made it a regular practice to collect forfeited deposits from prospective homebuyers. In fact, it was the builder's No. 1 source of profit during the down years of the housing market, according to a Maryland class action lawsuit.

From fiscal years 2006 to 2011, according to its own SEC reports, the publicly traded company retained $123 million in forfeited deposits from 3,300 prospective homebuyers.

Though Toll Brothers insists that it keeps deposits only when buyers violate the terms of signed contracts, an attorney who represents clients trying to recoup deposits said the builder is the most aggressive firm in the industry in resisting fair settlements and keeping deposits even when the company suffered no financial harm from a failed deal.

"I represent builders who would never consider deposits as a potential profit

center," West Chester, Pa., attorney James Tupitza said.

Most deposits are lost due to Toll Brothers' rigid loan-approval contract language, he said. He provided this newspaper with contracts from other builders that include more permissive language, reducing buyers' risk when financing falls through.

Holding buyers to contractual deposits is an industry standard necessary to provide protection when building customized homes and to recover costs, such as real estate taxes, borne from carrying vacant properties, Toll said in a prepared statement.

And what is undisputed is the Sharmas and other Toll Brothers buyers upset by the company's actions all signed Toll Brothers' contracts. In fact, the Sharmas in arbitration this year lost their argument that the company should repay them.

"Right now ... if I can save other people from falling into this same trap," said Daven Sharma, 53, a self-employed CPA, "that's the only positive I can think of."

Is it a trap?

A March 3, 2011, class action lawsuit against Toll Brothers alleges the cancellation of contracts after failure to obtain loan approvals made up the bulk of Toll Brothers' forfeiture profits.

Marino, who filed the lawsuit, declined to comment.

Tupitza said he had to pull out the loan contingency paragraph in Toll Brothers' contract, write it in large letters on a white board in his office and then diagram it as a sentence to try to make sense of it, he said.

One of his clients received a loan commitment from Toll Brothers that included such unrealistic conditions as his client selling his own home for $85,000 above the listed price and qualifying for a loan amount higher than any bank would offer. And when the conditions aren't met, Toll Brothers keeps the deposit.

"They can make more money by not building the house," he said.

'Standard in the industry'

In a one-page statement, Toll Brothers explained that down payments are a "critical part of the homebuying process."

"In general, we do not build a home until it is contracted by a homebuyer, which enables our buyer to customize their home to their specific tastes and preferences with extensive option selections," the company said. "The down payment is intended to protect us against the significant risk associated with building a house customized for a certain buyer who does not close on it, the costs associated with holding such inventory until another buyer is found, and the discounts or incentives we must give the new buyer."

In addition, Toll Brothers said it has costs for carrying a vacant home, such as real estate taxes, landscaping, utilities, interest, transaction expenses and homeowner association dues.

"Our policy of retaining down payments is not a profit center; rather it is designed to mitigate these risks and costs," the company said. "Such a policy is standard in the industry."

Jim Daman went toe-to-toe with Toll Brothers in 2007 after putting down $104,000 for a $2.2 million home in Danville. He was promised the home would be built in six months, but as construction lagged the market value dropped to $1.4 million. A manager told him he would get his whole deposit back, but then reneged, he said.

Daman, a former real estate agent, sued in Contra Costa Superior Court and eventually settled for $70,000, but lost about $50,000 in forfeited deposit and attorney fees.

"They're nasty people. When you said 'Toll Brothers,' I started laughing and thinking, 'There is a god somewhere,'" the Danville resident told a reporter. "The contract is 99.9 percent in their favor."

On May 24, 2010, the Sharmas agreed to pay $1.1 million for a two-story, four-bedroom home to be built on a dirt lot with views of the Bay Bridge. They put down $98,220 in deposits, listed their Pleasanton house on the market and signed the contract, which was contingent on a loan approval within 30 days.

The Sharmas say they were told to go through Toll Brothers' in-house mortgage company TBI Mortgage, and that if TBI or another bank would not fund the loan, they would get their deposits back.

But when their Pleasanton house did not sell, the Sharmas told Toll Brothers they would give up their contract if they could get back their deposit.

"The salesperson said, 'Too bad. You are under contract,'" Sharma said.

A few weeks later, the Sharmas received a "commitment letter" for a mortgage from U.S. Bank, to whom they had never applied for a loan. The mortgage required the sale of their Pleasanton home, a contingency at that point the Sharmas could not meet.

The two sides could not settle and headed into arbitration -- the only way to dispute contractual issues with most builders, including Toll Brothers.

Representatives from the builder said the Sharmas were too far along to back out, saying "the Sharmas customized the new home to their tastes and we began construction, (and) the Sharmas changed their mind."

Said Sharma, "They sold me a piece of dirt and they got dirt back, so they were whole." A photo taken Sept. 18, 2010, a day after Toll Brothers sent a letter of default to the Sharmas, shows only wood forms on a dirt lot.

Not only did Sharma lose his full deposit in arbitration, but he had to pay $5,600 in Toll Brothers arbitration costs.

Sharma said his family is traumatized and disillusioned.

"It amazes me that a lady who spills McDonald's coffee can make millions and here I have evidence in black-and-white and nothing can be done about it."

An attorney claims Toll's language is confusing and leans far in favor of the seller. Here is the sentence that leaves buyers with few ways to get their deposits back:
"Buyer's failure to fulfill any of such conditions or the termination or expiration of the mortgage commitment after it is received, for any reason, shall not release Buyer from its obligations under the Agreement."

How to avoid a bad home contract
Here are some key points on what to look for when signing a contract to buy a new home:

  • Make sure the contract includes a provision allowing for a refund of your deposit if you are unable to obtain financing -- within a reasonable specified time -- or if the seller or builder fails to perform his or her part of the contract.
  • If possible, make your deposit and down payment into an escrow account, rather than directly to the seller.
  • Have a real estate agent or attorney go over the agreement before signing.
  • Make sure the sales price is specified in the contract.
  • Ensure the contract requires the seller to transfer the property to you on or before a certain date. The contract should also specify your right to withdraw and get your deposit back if the property is not transferred on time.

    William and Kate greet torch as fever mounts

    Prince William and his wife Catherine welcomed the Olympic flame to Buckingham Palace Thursday as 60,000 people partied in Hyde Park to mark the penultimate day of its marathon journey around Britain.

    The excitement on the eve of the Games mounted as a delighted William and his wife and his brother Prince Harry applauded as the torch was brought into the palace grounds, with thousands of fans cheering outside the gates.

    The flame is touring some of London's best-known landmarks, carried by movie stars, sporting heroes and even UN chief Ban Ki-moon, before it finally makes its dramatic entrance at the Olympic Stadium for the opening ceremony.

    The royals all wore Team Great Britain t-shirts as the flame stopped at the palace on its way to Hyde Park, where a deafening roar from the crowd greeted the torch before a special concert in its honour.

    London's Mayor Boris Johnson whipped them up, telling them "Olympo-mania" was about to go off the scale.

    "People are coming from around the world and they're seeing us and they're seeing the greatest city on Earth," he said.

    Johnson said the British team would win "more gold, silver and bronze medals than you need to bail out Greece and Spain together!"

    Millions of Londoners have come out onto the streets over the past week to show their support as the pre-Games excitement builds.

    A total of 173 torchbearers carried the flame on a journey round London's attractions on Thursday, as it nears the end of its 70-day, 8,000-mile (12,875-kilometre) journey around Britain.

    They included Indian movie star Amitabh Bachchan, the United Nations secretary general and Indian steel magnate Lakshmi Mittal.

    At Buckingham Palace, Wai Ming-Lee, 38, who volunteers with a disaster mapping charity, brought the flame into the palace grounds, and lit the torch of 56-year-old mountain rescue volunteer John Hulse in front of the royals.

    The flame was earlier carried past the Houses of Parliament, while Prime Minister David Cameron welcomed the relay to his Downing Street office.

    Workers in London's City financial heartland poured out onto the streets to greet the flame.

    Hundreds gathered outside St. Paul's Cathedral, while others leaned out of their office windows waving British flags.

    "The whole office is here. And if you knew how hard we work, it's a big deal", said Ryan, 20.

    At St. Paul's, "we talk a lot about peace", said Reverend Canon Michael Hampel, and the flame coming to visit "is an opportunity to bring the nation together", he told AFP.

    Kevin Craig, who helps a charity which provides limbs to children in developing countries, brought the flame to the cathedral.

    "Apart from meeting my wonderful wife and the birth of my children, it was the most amazing time in my life," he said.

    The flame was then carried across the Millennium Bridge over the River Thames by British Paralympic basketball bronze medallist Ade Adepitan.

    At the BBC's headquarters in west London, Antoine de Navacelle -- the great grand-nephew of Pierre de Coubertin, the father of the modern Olympics -- exchanged the flame at the site of the finish line of the 1908 London Games' White City stadium.

    How the flame will be lit in the Olympic Stadium is a closely-guarded secret.

    Man hides cash in oven; cash gets baked by accident

    One man probably has learned a costly lesson about where he hides his cash.

    The unidentified man from Sydney, Australia, sold his car last weekend. The $15,000 (approximately $15,652 in U.S. dollars) in proceeds was earmarked for his mortgage payment and other bills, according to Australian media. Opting not to squirrel away the loot in a mattress or bury it in his backyard, he decided to hide it his oven, which rarely gets used.

    Bad move: Turns out, his wife decided to use the oven that day, preheating it for chicken nuggets and, yes, cooked the cash.

    "It was everything I had," he told the news station. "I've got nothing to my name. That money was supposed to go towards my mortgage."

    His wife was equally distraught and, reportedly, could not stop crying when telling her husband after she discovered what happened: The cash was baked into a colorful burnt mess.

    The man reached out to his lender and the Reserve Bank of Australia for help.

    The Reserve Bank advises people to take damaged currency to a bank. According to the Reserve Bank policy, "if several pieces of the same banknote are presented, the Reserve Bank's policy is for each piece to be worth a share of the value in proportion to its size... The combined value paid should be the face value of the original banknote."

    Journey to She Speaks Part II: A Teachable Heart

    (If you haven't checked out Part I of this series please visit yesterdays post here first.)

    Friday July 20th 5:45AM

    Dave's parents came to our house to pick me up and take me to the airport. ?I had insisted it wasn't necessary. ?Our airport is so small that I knew since I'd already checked in online that they would literally be dropping me off and I would almost immediately be walking through security, and at that point they wouldn't be able to come anyway. ?Abbie happened to be awake cause she heard me getting ready so she got to come too and in hindsight I do admit...it was nice having someone take me. ?Less lonely. ?Less scary. ?

    Security literally took 5 minutes to walk through and my terminal was right on the other side of it. ?I am pretty sure our airport has only 10-15 terminals. ?I have never had to walk out onto the concrete "runaway" and walk up the stairs of the actual plane to get on before but this time I did.....I have never flown through our airport in town so I almost felt like I was breaking a law walking outside right under the plane to get on. ?Our plane was the smallest plane I had ever been on and I at times can be a bit claustrophobic. ?A big gentleman sat down next to me who I shortly found out went to one of our local catholic churches and was a very active father to 4 daughters and involved in the youth at the church. ?He was a nice guy and I was glad for the company to get my mind off of my claustrophobia. ?He was actually really encouraging since I have a daughter, giving me bits of wisdom for life down the road with a teenage girl. ?He and his wife had always maintained open communication with their girls, friends with them yet still parents and I liked the combination and the type of trusting relationship that he seemed to have with each of his girls. ?I pocketed the wisdom for much further down the road when Abbie is a teenager :)
    My connecting flight arrived in Detroit about 50 minutes later and I had about an hour between flights. ?Perfect amount of time in my opinion. ?Unless you are flying through Atlanta. ?Then I need time to hyperventilate between trying to make sure I make the right flight while sprinting miles through each concourse. ?I had just enough time to grab some starbucks and get ready to board by the time I found my terminal. ?The flight to Charlotte was about an hour and 45 minutes and I spent most of it reading a book I had checked out from the library on writing. ?You see going into this conference I wasn't sure what God was calling me to do. ?This conference called?She Speaks?through?Proverbs 31 Ministeries, is for Christian Women Writers and Speakers. ?I just knew clearly without a doubt that God was asking me to go and so I went. ?I had been praying about what he wanted for me to do and before I left I kind of felt like it might be more writing. ?It made sense to me. ?I have a small toddler and we hope to have more children in the future. ?Where in the world would I fit speaking around my already busy life? ?So writing just made sense to me. ?I was attending sessions at the conference on both writing and speaking though. ?One of the speakers at Proverbs 31 had encouraged me when I registered and said "Ultimately writers become speakers, and speakers become writers." ?Which is very true. ?Regardless of what God revealed to my heart, I knew there was one that would have more of a focus in my life, and the other would be there but more on the backburner. ?

    I arrived in Charlotte North Carolina around noon EST and found the shuttle to our hotel. ?It was about a 25 minute drive from the airport to our hotel and I met some great women who also were going to the conference while I was on there. ?My sessions started shortly after arriving at the hotel. ?This place was nothing short of amazing. ?The place itself was just a normal hotel with a convention center attached but just the feeling of being surrounded by 650 women who all were there for the same reasons I was, being obedient to what God asked of them and seeking out God's will in their lives about speaking and writing was overwhelming. ?I had met many of the women online through a facebook group, but I had no idea how hard it would be to find those very same faces in a large group. ?650 didn't sound like a huge number to me, but turns out, it was a bit overwhelming. ?I did the best I could to be outgoing and talkative and not hide in the shell I wanted to hide in. ?Turns out I realized how much I missed the confident me. ?The person who used to not care so much about what people thought about her. ?The person who didn't put so much effort into people pleasing and instead just chose to love people regardless of their brokenness. ?My old extroverted self started to come out and it was nice. ?It was nice to be real again. ?To know people may hurt me sometimes but that I didn't have to hide. ?And here, in this place, it was safe. ?I could be me. ?I could be transparent. ?I could be real. ?

    Now most Christians know that when God asks you to do something, spiritual warfare is quick to follow, from the time I said yes to going, up until right before I left to go, there was spiritual attack after spiritual attack. ?Many others came to the conference with much different stories than mine, but still many struggles, hurt hearts, each clinging to their Savior's promise for healing. ?There was a special prayer room where you could go and pray quietly or have someone pray for you, and a few days before the conference started we received an email from Proverbs 31 saying that each of our names had being prayed over for months, and in the prayer room there would be scripture. ?Each of our names had been placed by scripture that they felt God leading it to be put on. ?Tears streamed down my face when I read that email. ?So excited to see what God put on these beautiful womens hearts about me. ?When I got into the prayer room the name and scripture of God they had assigned to my name was:

    Truth and mercy washed over me in that moment and I knew that He knew exactly what had happened for me to be there at that conference. ?That I didn't have to be scared. ?That I didn't have to lack confidence but that He fully knew and He is good. ?My father cares for his children. ?

    I got prayer in the prayer room that night. ?From a girl named Stephanie. ?Someone who would start to become far more important in my life than a random girl who prayed for me once. ?As I sobbed and told her my story she prayed a compassionate prayer and it was there from her that I began to notice a theme in things that God was speaking to my heart about from the weekend.

    I finally got a chance to meet my roommate that night about 10PM. ?Poor thing ?had gone through so much to get there- missing flights, being on stand by after standby, storms causing rerouting for her plane to land, and she finally had gotten to the hotel about 8PM (she was supposed to arrive around noon) that night just in time to present her speech to her evaluation group. ?Like I said....satan didn't stop working on tearing any of us down to get there!

    She was such a joy to talk to. ?We had emailed back and forth a few times before going so we knew what the other looked like and a bit about each others lives. ?It was a joy to spend part of my weekend with her and get to know her better!

    Saturday was filled with session after session of amazing writing and speaking material and by about 3:30 my brain couldn't take anymore. ?I struggled through that session to listen and grasp what I could but my brain was on overload and I was craving sometime to just go spend with God, praying, reading his word, and sorting through what He was laying on my heart. ?Luckily for me I had opted for free time at 4PM instead of taking another session so I had an hour and a half to go do just that. ?

    My time with God that afternoon was much needed. ?I prayed about some of the things I felt him laying on my heart. ?I asked for wisdom on whether he was leading me to write or speak. ?I read new scripture and by the end of my time He had given me much insight. ?I wasn't really sure if he would reveal anything to me that day or if it would be a longer process of reveal but He did and I am so greatful. ?You see in my mind as I asked God about speaking and writing, writing just made more sense to me. ?I have a toddler. ?Writing would work better around my schedule because I could write after she goes to bed or during naptimes etc, but speaking? ?How do I speak when I have a toddler? ?I don't want to leave my family all the time to go speak somewhere, but you see God knows our hearts. ?He knows our needs, and my problem was, that I was looking at people who speak all the time and was getting ahead of myself. ?I haven't started any of it yet except blogging. ?God knows my exact spot in life. ?He knows I have a young daughter. ?He knows I'm married. ?He knows we want more children. ?He knows. ?He will never give me more than I can handle and if I just submit everyday to Him and ask Him what He specifically wants for my day, I won't miss any appointments He has for me, He will give me the strength to know how to fit marriage, and parenting in with other things He might want for me, and at the same time not to undermine my roles in my husband and children's lives...they are huge responsibilities and a major part of my God given tasks! ?I decided at that point in my quiet time to read through the scripture again He had laid on my heart from Isaiah 6, and also Titus 2- those verses had been on my heart even longer

    Tears fell and I knew, plain as day God was speaking to me. ?I knew that it wasn't that He didn't want me to write, but that He had always wanted me to speak. ?That to choose writing, and refusing to speak would be using writing as a crutch to hide behind.

    (AP) ? Robert Downey Jr. made a Tony Stark-like entrance Saturday into the San Diego Convention Center's largest exhibition hall, dancing up through the aisles among more than 6,000 fans.

    The "Iron Man" star joined Marvel Studios chief Kevin Feige at Comic-Con to show footage from the film, due next summer, and announce the studio's upcoming superhero film slate. He appeared while wearing the right hand of his "Iron Man" costume with a suit and tie.

    The "Iron Man 3" clip showed Stark's latest incarnation of his super suit, pieces of which fly across his workshop and attach themselves to his body. It showed his cliffside compound crumbling into the sea and his cache of Iron Man suits being blasted to bits.

    The footage also offered a look at Sir Ben Kingsley as the villain Mandarin and franchise newcomers Guy Pearce and Rebecca Hall, along with the return of Gwyneth Paltrow's Pepper Potts, Don Cheadle's James Rhodes and Jon Favreau's Happy Hogan.

    Favreau, who directed the first two "Iron Man" films, served as an executive producer on the third installment.

    "I feel like a proud grandfather who doesn't have to change the diapers but gets to play with the baby," Favreau said, appearing on the Marvel panel with Cheadle and "Iron Man 3" director Shane Black.

    Black said the film explores the roots of Stark's mythology and feels like a culmination to the trilogy.

    As to whether there could be more "Iron Man" movies after this one, Downey said: "The future is uncertain."

    "I'm super happy and this has been just an amazing journey," he said.

    Feige also announced other upcoming Marvel movies, including "Thor: The Dark World," ''Captain America: The Winter Soldier," the anticipated "Guardians of the Galaxy" and "Ant Man."

    Director Edgar Wright made a surprise appearance at the panel and showed his test shots for the big-screen adaptation.

    "I can reveal that Ant Man has been here the whole day," Wright said of the diminutive superhero. "In fact, he was here to spy on the 'Pacific Rim' panel," where Guillermo del Toro gave a look at his giant-robot-versus-massive-monsters flick earlier Saturday.

    Israel to allow family visits for some Gaza prisoners

    RAMALLAH (Ma?an) -- The Palestinian Authority prisoners minister said Saturday that the Israeli Prison Service will allow the families of 25 Gaza prisoners to visit their loved ones in jail on an "experimental basis."

    Issa Qaraqe said the families will be able to visit starting July 16 but will be limited. There is still some opposition to letting Gaza's 473 prisoners receive visits, he said.

    Some of the limitations put in place include a ban on children while the Rimon prison is not allowed visitors at all, the official said, calling Israel's policy toward detainees "collective punishment."

    Israel started limiting what it considers privileges for Hamas and Gaza prisoners in a bid to put pressure on Hamas to release Israeli soldier Gilad Shalit, who was held in Gaza until last fall.

    The visitors issue was one of the key demands of the hundreds of prisoners who went on a hunger strike in the spring.

    In a deal to end the strike, Israeli authorities agreed to allow limited personal visits.

    Analysis: In the U.S. housing market, recovery or Lost Decade?

    (Reuters) - The worst U.S. housing crisis since the Great Depression has been declared over. But is it?

    What some of Wall Street's forecasts for a recovery may be underestimating are tectonic shifts in the U.S. economy that make the housing market a different place from a decade ago.

    Record levels of student debt, 15 years of flat incomes and the fact that nearly half of homeowners are effectively stranded in their houses look likely to weigh on prices into the indefinite future.

    Several housing experts have said the market is in danger of drifting for years. In a bleaker scenario, the fragile U.S. economic recovery could slip back into recession if Europe's crisis deepens or the political impasse in Washington triggers a new budget crisis, putting the housing market at risk again.

    "We've gone through half of a lost decade since the crisis started in 2007," said Robert Shiller, co-founder of the Case-Shiller U.S. housing price index and an economics professor at Yale University.

    The so-called Lost Decade in Japan occurred after the speculative bubble in the 1980s, when abnormally low interest rates fueled soaring property values. The ensuing crash has continued to afflict the Japanese economy ever since.

    "It seems to me that a plausible forecast is, given our inability to do stimulus now, for Japan-like slow growth for the next five years in the economy. Therefore, if there is an increase in home prices, it's modest," said Shiller.

    A Reuters poll published on Friday showed most economists think the U.S. housing market has now bottomed and prices should rise nearly 2 percent in 2013 after a flat 2012.

    GENERATION STAGNATION

    Consider the plight of college graduates, who go on to become the biggest group of first-time U.S. home buyers.

    Many graduate into a climate of falling wages and soaring rents, members of the most indebted generation in history who owe an average $25,000 in student loans.

    They elbow their way into a labor market so rough that the number of people with jobs is at a 30-year low, health and retirement benefits are shrinking and the young workers face a greater chance of losing their jobs than any generation before.

    For Steve Blitz, chief economist at ITG Investment Research in New York, the housing market improvement has gotten as good as it can without more improvement in the labor market.

    "I don't see it worsening unless the economy goes back into a recession, but I think it's more a case of stagnating," Blitz said.

    It is not just the employment picture that makes the prospect of a housing recovery so precarious.

    Housing prices and income usually move in lock step. But real median household income is stuck at the same level as during the Clinton Administration in 1996 -- at about $49,000.

    That means the housing market will remain troubled for "an extended period of time," according to Sam Khater, a senior economist at housing data company CoreLogic.

    "It's not about job growth. It's about income growth," says Khater.

    Back in 1996, the median home price was around $80,000. When house prices soared to $200,000 in 2006 -- the market peak -- it was due to jumbo mortgages, not jumbo pay raises.

    Banks lured consumers with low interest rates that later turned much more expensive and blew up monthly payments, eventually helping to cause the housing crash.

    On the one hand, the housing implosion has created a bonanza for those buyers who can take advantage of it: U.S. real estate is now 36 percent cheaper than in 2006.

    In nearly every city, it now costs less to own than to rent.

    But many would-be homeowners cannot buy. Lenders have virtually locked them out of the market by denying them mortgages, according to statistics from the Federal Housing Administration and a recent Morgan Stanley research report.

    In May, consumers able to close on a mortgage had, on average, a near-perfect credit score. They could afford a 19 percent down payment on their new home. And they were still on track to spend no more 24 percent of their income on their new house, according to the Ellie Mae Origination Insight Report.

    "Most of the population can't meet current mortgage underwriting standards," says trade publication Inside Mortgage Finance founder Guy Cecala. "They're getting eliminated before they even get to the door."

    Some believe this credit freeze is only going to worsen. Washington is considering new mortgage regulations that would shift more responsibility for bad loans away from taxpayers and investors and toward banks.

    "If all these new rules that Washington is talking about are put into place, it would be even harder to get a mortgage," said Brian Lindy, an analyst at Amherst Securities Group, which released a report in May entitled "The Coming Crisis in Credit Availability."

    Even for those who can afford to, buying a house can be a harrowing experience. After watching a nation crash and burn, plenty of people remain in shock. They are loath to take the risk anytime soon.

    As research firm S&P Capital IQ's Robert Kaiser said at a recent housing conference: "Consumer confidence simply hasn't recovered enough to support the housing market."

    BUSTED CONVEYOR BELT

    The housing market, as economists often like to point out, is a conveyor belt. A homeowner sells a house. The new buyer moves in, and the seller buys a better house. In time, that buyer in turn sells, and buys a better house.

    Normally these so-called move-up buyers are the housing market's biggest consumer group. They are what keep that conveyor belt moving.

    Today the apparatus is broken.

    That's because about half of homeowners with mortgages simply can't move.

    Twenty-four percent owe more on their houses than they are worth. Another 25 percent are equity poor, meaning they have less than the 20 percent of equity required for a down payment to trade up to a new home, according to housing-data company CoreLogic.

    Sean O'Toole, the CEO of foreclosure-data aggregator ForeclosureRadar.com, estimates that it will take at least another decade, at the housing market's current pace of growth, for homeowners who are underwater just to break even on their houses.

    "We went from $4.5 trillion of mortgage debt in 2000 to $10.5 trillion of debt in 2008 -- and we are still only down to $9.8 trillion," says O'Toole.

    "All those people with negative equity, they can't sell. They are stuck in a prison of debt."

    A HIT WITH MULTI-GENERATIONAL HOMES

    The U.S. housing market is actually hundreds if not thousands of markets.

    Cities such as New York and San Francisco have joined other world cities, like London and Hong Kong, to form a global housing market that aligns its fortunes with the wealthy elite.

    Then there's Stockton, the California city that filed for bankruptcy in June. A recent Rockefeller Institute of Government research report suggested it could turn into a ghost town with its lack of jobs and abundance of abandoned, foreclosed homes.

    Still, there's no doubt that in most places the housing market appears to have bottomed out and is now gathering strength.

    The places that were hit hardest -- like the warm states where baby boomers go to retire -- are snapping back, and some states with strong income and job growth, like the natural gas haven of North Dakota, are solid.

    "I don't think it's a head-fake, because when you look across all your price measures and construction measures on the starts side, you're seeing broad-based indication of improvement," says Beata Caranci, deputy chief economist at TD Bank Group in Toronto.

    But even those who say the recovery is on are subdued. "We have to be a little bit cautious," said Caranci. "It's the beginning of a recovery."

    The Case-Shiller home price index, considered a bellwether of the U.S. housing markets, rose in May for the third consecutive month.

    Those price hikes, however, reversed just a sliver of the wealth lost since the housing peak: $200 billion of the $6.7 trillion that has evaporated since 2006, according to a recent Bank of America report.

    Some of the biggest jumps -- such as the 10 percent year-over-year price gains in foreclosure-filled cities like Phoenix and Miami -- were largely due to banks holding back inventory. That's because of lingering legal problems from the so-called robo-signing foreclosure scandal as well as a reluctance to flood the market, according to CoreLogic's Khater.

    "Don't let the volatility in prices fool you," he said. "Yes, prices are increasing in some markets, but in the longer term it has to come back to incomes, and unless incomes are increasing, price increases are not sustainable."

    At this point in a typical cycle, executives at the homebuilding companies are usually the loudest members of the housing recovery pep squad. Yet the mood has been subdued in the most recent round of earnings conference calls with homebuilder executives.

    In late June, Lennar, the third-largest homebuilder in the United States, reported a rise in new orders for the fifth straight quarter, helping to push share price to a year high in July.

    Executives had foreseen that, after the housing crash, family members would start to live together as a way to save. Lennar started designing a new home that included a 600-square-foot apartment with its own entrance called the "Multi Gen Home." It has been a hit.

    Nonetheless, Lennar's chief executive officer, Stuart A. Miller, told analysts in June that he was nervous about uttering the word recovery.

    "I don't think that there's reason for exuberance right now -- except for the fact that the beatings have stopped."
